Booking Terms & Conditions

These Booking Terms and Conditions ('Terms') govern your booking and attendance at WhenI'm courses. By making a booking, you agree to be bound by these Terms. Please read them carefully before completing your booking.

WhenI'm is operated by Jude Gardner, a company registered in England and Wales under company number 16607764, with its registered office at Freshmills, Delta House, Bridge Road, Haywards Heath, West Sussex, RH16 1UA.

1. COURSE INFORMATION

1.1 Course Structure
WhenI'm courses consist of 6 classes, each lasting 2 hours. Classes are held at local venues in a supportive, friendly environment. A tea, coffee, or soft drink is included in the cost of each class.

1.2 Course Pricing

  • Individual class: £300 (covers all 6 classes)

  • Couples course: £500 (covers all 6 classes for two people)


1.3 Minimum Numbers
A minimum of 6 people is required for an Individual course to proceed and 6 couples for a Couples course to proceed. If insufficient bookings are received, we will contact you to arrange an alternative date that suits you. We will give you as much notice as possible if this occurs.

1.4 Age Requirement
All participants must be 18 years of age or older.

2. BOOKING AND PAYMENT

2.1 Booking Process
To secure your place on a WhenI'm course, you must:

  • Complete the online booking form through the WhenI'm booking system

  • Pay a non-refundable deposit of £50 via the Wix payment/online booking system

  • Provide accurate contact and payment information


2.2 Deposit
A £50 deposit is required at the time of booking. This deposit:

  • Is non-refundable in all circumstances

  • Secures your place on the course

  • Will be deducted from the total course fee

  • Can be transferred to an alternative date if you need to change your booking (subject to availability)


2.3 Final Payment
10 working days before the course start date, WhenI'm will send you an invoice for the remaining balance:

  • Individual class: £250 remaining balance

  • Couples course: £450 remaining balance

The remaining balance must be paid by bank transfer to WhenI'm no later than 5 working days before the course starts.

2.4 Non-Payment
If the final payment is not received 5 working days before the course starts:

  • We will contact you to arrange payment

  • We will attempt to secure payment by the start of the course

  • If we do not hear from you or cannot reach an alternative arrangement, your place will be forfeited and reallocated to another participant

  • Your £50 deposit will not be refunded if your place is forfeited due to non-payment


2.5 Booking Confirmation
Upon successful booking and deposit payment, you will receive:

  • A confirmation email via the WhenI'm booking system

  • An invoice for the final payment (sent 10 working days before the course start date)

When the final payment is received, you will receive:

  • A final confirmation email

  • Full course details including venue address, timings, and any preparation required


3. CANCELLATIONS AND REFUNDS

3.1 Cancellation by You
Deposit:

  • The £50 deposit is non-refundable under all circumstances

  • If you cancel your booking, we will work with you to find a new date or alternative course

  • Your deposit can be transferred to a future course (subject to availability)

Full Payment Cancellations:
If you have paid the full course fee and need to cancel:

  • 30 days or more before the course starts: Full refund minus the £50 non-refundable deposit

  • 7-29 days before the course starts: 50% refund (minus the £50 deposit)

  • Less than 7 days before the course starts: No refund

All refunds will be processed within 14 working days of your cancellation notification.
3.2 Cancellation by WhenI'm
If WhenI'm needs to cancel or postpone a course (for example, due to insufficient bookings, instructor illness, or unforeseen circumstances):

  • We will give you as much notice as possible

  • We will arrange alternative dates to complete the course

  • We will work with you to find dates that suit your schedule

  • If no suitable alternative dates can be arranged, we will provide a full refund of any classes missed

WhenI'm is not liable for any travel expenses, accommodation costs, or other expenses incurred in anticipation of attending a cancelled course.

4. CHANGES TO YOUR BOOKING

4.1 Changing Course Dates
If you need to switch to a different course date:

  • You must provide at least 7 days' notice

  • We will do our best to accommodate your request, subject to availability

  • Your deposit and any payments made will be transferred to the new course date

  • If you provide less than 7 days' notice, standard cancellation terms apply (see Section 3.1)


4.2 Transferring Your Place
You may transfer your place to another person, provided that:

  • The transfer is requested at the beginning of the course (before the first class)

  • The replacement person meets the course requirements (e.g., for Couples, Men Only, or Women Only courses)

  • The replacement person is 18 years of age or older

  • You notify WhenI'm in writing via email of the transfer

  • The replacement person agrees to these Terms and Conditions

Once a place has been transferred, the original booking holder is released from all obligations under these Terms.

5. ATTENDANCE

5.1 Attendance Requirement
Attendance at all 6 sessions is required for your education and enjoyment, and to benefit from the group dynamic that makes WhenI'm courses effective.

5.2 Missed Sessions
If you miss one or two sessions due to unavoidable circumstances:

  • We will try our best to accommodate you in the missed sessions in later courses

  • You may need to join a different group to make up the missed sessions

  • This is subject to availability and may not always be possible

  • Please notify us as soon as possible if you know you will miss a session

No refunds will be provided for missed sessions.

6. COURSE MATERIALS AND RESOURCES

6.1 What's Provided
The course fee includes:

  • All course materials and resources

  • Tea, coffee, or soft drinks at each session

  • Access to the venue for the duration of each class


6.2 What to Bring
You are welcome to bring whatever helps you learn, such as:

  • Pen and paper

  • A laptop or tablet (if you find it useful)

  • Any personal notes or financial documents you wish to reference (optional)

You are not required to bring any specific materials.

7. PRIVACY AND CONFIDENTIALITY

7.1 Group Confidentiality Agreement
At the beginning of each course, all participants will be asked to sign a confidentiality agreement to:

  • Respect the privacy of the course moderator and other participants

  • Not use other participants' real names outside the course

  • Not repeat or share other people's personal situations or financial information

  • Maintain confidentiality about what is discussed in the sessions


7.2 Recording Prohibition
To protect the privacy of all participants:

  • Classes cannot be audio or video recorded by participants

  • Photographs of other participants are not permitted without their explicit consent

  • Breach of this policy may result in removal from the course without refund


7.3 Personal Data
Your personal information will be handled in accordance with our Privacy Policy, available at www.whenim.co.uk. By booking a course, you consent to us processing your personal data for the purposes of administering your booking and delivering the course.

7.4 Photos and Testimonials
WhenI'm may wish to take photographs during courses or request testimonials for promotional purposes. We will:

  • Always seek your explicit consent before taking any photographs that include you

  • Ask for your permission before using any testimonials or feedback publicly

  • Obtain your written consent before using your image or words in marketing materials

  • Allow you to withdraw consent at any time

You are under no obligation to provide consent for photographs or testimonials, and refusal will not affect your participation in the course.

8. NATURE OF WHENI'M SERVICES

8.1 Education and Guidance Only
WhenI'm does not provide 'financial advice' as defined by the Financial Conduct Authority (FCA).
According to the FCA, regulated financial advice involves making a personal recommendation to a person in their capacity as an investor about buying, selling, subscribing for, or underwriting a particular investment or engaging in investment activity.
WhenI'm provides:

  • Education: Information about pensions, retirement planning, and financial matters

  • Guidance: General guidance to help you understand your options

  • Information: Factual information about financial products and services

  • Tools and frameworks: Resources to help you make your own informed decisions

WhenI'm does not:

  • Make personal recommendations about specific financial products

  • Tell you what investments to make

  • Recommend specific courses of action tailored to your individual circumstances

  • Provide regulated financial advice or investment advice


8.2 Suggestions and References
During courses, WhenI'm may:

  • Suggest different websites, tools, or resources

  • Mention providers of financial services

  • Reference financial advisers, legal advisers, or other professionals

  • Discuss charity organisations or support services

These suggestions and references do not constitute financial advice or personal recommendations. They are provided for educational and informational purposes only.
8.3 Provider Relationships
WhenI'm may have relationships with certain providers of financial, legal, or charity services, which may include two-way referral arrangements. However:

  • WhenI'm will always provide a range of providers for you to consider

  • It is entirely your choice which supplier or provider you select

  • Any referral relationships will be disclosed to you

  • You are under no obligation to use any suggested provider


8.4 Your Responsibility
It is your responsibility to:

  • Make your own financial decisions

  • Seek regulated financial advice if you need personal recommendations

  • Verify that any financial adviser you choose is authorised by the FCA

  • Conduct your own research before making financial decisions

  • Consider your own circumstances, risk tolerance, and financial goals


9. LIABILITY AND INDEMNITY

9.1 Limitation of Liability
To the fullest extent permitted by law:

  • WhenI'm is not liable for any financial losses or damages arising from decisions you make based on information provided in our courses

  • WhenI'm is not liable for any loss, theft, or damage to your personal belongings during courses

  • WhenI'm is not responsible for the performance, services, or conduct of any third-party providers mentioned during courses

  • WhenI'm is not liable for any injuries sustained at the venue, except where caused by our negligence


9.2 Venue Liability
Course venues are selected with care, but:

  • You are responsible for your own safety at the venue

  • You should take reasonable care of your personal belongings

  • WhenI'm is not responsible for any damage or loss caused by the venue or its facilities

  • Any issues with venue facilities should be reported to venue staff and WhenI'm immediately


9.3 Exceptions to Limitation of Liability
Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence

  • Fraud or fraudulent misrepresentation

  • Any other liability that cannot be excluded or limited by law


10. CONDUCT AND BEHAVIOUR

10.1 Expected Behaviour
All participants are expected to:

  • Treat the course moderator and other participants with respect and courtesy

  • Arrive on time for each session

  • Participate constructively in group discussions

  • Respect the confidentiality agreement

  • Refrain from disruptive, offensive, or inappropriate behaviour

  • Follow venue rules and regulations


10.2 Right to Remove
WhenI'm reserves the right to remove any participant from a course, without refund, if their behaviour:

  • Is disruptive to other participants or the course moderator

  • Breaches the confidentiality agreement

  • Is offensive, discriminatory, or harassing

  • Violates these Terms and Conditions

  • Poses a risk to health, safety, or wellbeing of others


11. FORCE MAJEURE
WhenI'm is not liable for any failure or delay in performing its obligations under these Terms if such failure or delay is due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, severe weather

  • Pandemics or public health emergencies

  • War, terrorism, civil unrest

  • Government restrictions or legal prohibitions

  • Strikes, labour disputes

  • Failure of utilities, telecommunications, or transport networks

  • Venue unavailability due to circumstances beyond our control

In such circumstances, we will work with you to arrange alternative dates or provide appropriate remedies.

12. GENERAL TERMS

12.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and WhenI'm regarding your booking and attendance at our courses.
12.2 Changes to Terms
WhenI'm reserves the right to update these Terms at any time. Any changes will:

  • Be posted on our website with an updated 'Last Updated' date

  • Not affect bookings already made under previous terms

  • Apply to all new bookings made after the update date

12.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
12.4 Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
12.5 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. WhenI'm may assign its rights and obligations under these Terms at any time.
12.6 Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your booking will be subject to the exclusive jurisdiction of the courts of England and Wales.
12.7 Consumer Rights
Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

13. COMPLAINTS AND DISPUTES

If you have any complaints or concerns about your WhenI'm course, please contact us first so we can try to resolve the issue:

We take all complaints seriously and will investigate and respond to your concerns promptly, typically within 14 working days.
If we cannot resolve your complaint to your satisfaction, you may have the right to refer the matter to alternative dispute resolution or the courts.
